Attention: Modification of Belgian law
As long as the total sales price (including VAT) of a vehicle is less than 3000 euros, it can be paid fully in cash.
However, if the total sales price of the vehicle is 3000 euros or higher, the vehicle must be paid by other means (i.e. electronic payment cards, wire transfer, cashier check, etc.).
The law provides for one exception: even if the total sales price is 3000 euros or more, an advance of up to 10% in cash may be paid, provided that the advance payment itself does not exceed the threshold of 3000 euros.
Penalties: if you carry out a cash payment in excess of 3000 euros, you can incur a penalty of between 250 and 225,000 euros.
General sale conditions of second-hand cars

are in agreement of the following conditions of sale:
All sales agreements are concluded by the seller subject to these sales conditions. Divergent stipulations, including the conditions of the client, only bind the seller where the latter has indicated its express agreement in writing.
Conclusion of the agreement
The buyer can purchase vehicles from the seller by making an offer foan available vehicle. This offer must be submitted online, unless otherwise determined, and must be effected within the bidding time as established by the seller. Through the submission of an offer, the buyer accepts the stated conditions of sale.
The buyer will be notified in writing, by means of an order form, as to whether the vehicle for which an offer was made was knocked down to him/ her.
The sales agreement will take effect after the buyer has fully completed and signed the order form and returned it to the seller within a period of 3 days.
The seller reserves the right to sell the vehicle to a next bidder or other buyer in the event that the applicable order form is not returned within the aforesaid period of time.
Prices, payment and transport modalities
The buyer is required to make payment , within a period of 10 days after notification of a succesful bid of the amount agreed at the time of sale. All costs arising from the sale of the vehicle such as, transport costs and reregistration fee, are payable by the purchaser. For domestic buyers, payment can only be accepted via bank transfer or by means of an endorsed cheque. For foreign buyers, payment can only be accepted via electronic transfer from the country of destination. All intra-Community sales excluding VAT must be transported by recognized transport : no own transportation is permitted, or transport with trailers and / or dealer plates.
In the event of non-payment of the full sales price within the stipulated period,
the seller may legally dissolve the sales agreement as entered into with the buyer and this without prior notice of default. In that event the seller may demand compensation from the buyer equal to the loss sustained with a minimum of 10% of the agreed net -selling price.
The place of delivery is Senator A Jeurissenlaan 1039 3520 Zonhoven .
Title to the vehicle will only be transferred on condition that full payment of the selling price and possible penalty interest and/ or costs has been made. In the case of a bank transfer, this means upon receipt of the full selling price at the expense of the seller.
The vehicle must be collected within 10 days after that the agreement has come into effect. The vehicle will be sold as is', of which the buyer has taken cognisance. The seller is at no time liable for any damage caused by the buyer and/ or a representative buyer. The delivered goods will be sold by the seller without warranty, unless stipulated otherwise.
The risk of the product is assumed by the buyer at the moment of delivery.
Retention of title
The product delivered by the seller remains the property of the seller until such time as full payment has been made. Should a third party desire to exercise rights over the product for as long as this remains the property of the seller, the buyer is obliged to inform the seller in writing of this without delay.
This agreement is subject to the law of Belgium. Any disputes will be submitted tothe competent Court in Hasselt.
Problems with the Volkswagen Group
As a car professional, you are aware that the Volkswagen group has recently admitted that they installed a software version to manipulate NOx emission values in test mode on their diesel engines of types EA 189 (Norm Euro 5) with a cylinder capacity of 1,2l, 1,6l and 2,0l, for Volkswagen, Volkswagen Commercial, Audi, Seat and Skoda makes.
These irregularities, of which Crashcars bv was totally unaware, are in any case the full responsibility of the Volkswagen group and its distribution network.
Consequently, Crashcars bv rejects any responsibility for any negative consequences these irregularities may have. Should the car bought from us be equipped with this software, the buyer will then accept that any damages can only be recovered from the Volkwagen group and absolves Crashcars bv of all responsibility.
